Before you use SMAC Energy Modeller

Disclaimer

SMAC Energy Modeller estimates and compares the annual energy use, humidity, comfort, costs and carbon of HVAC process options for one building. It is a decision-support tool for early design and option studies.

Results are estimates from a simplified hourly model and the inputs entered. They are not a guarantee of energy use, savings, comfort, humidity, mould risk or cost. Real performance depends on the design, installation, commissioning, controls, operation, maintenance and weather.
Default values and libraries (climate normals, equipment efficiencies, coil data, part-load curves, air speeds and occupant preferences, prices, emission factors, maintenance and embodied-carbon figures) are typical or indicative. Replace them with project and manufacturer data wherever you have it.
The drawings are illustrations of how each process works, not to scale and not for construction.
The tool does not size or select equipment for construction, and it does not show compliance with building codes, energy codes (including the Thai Building Energy Code) or standards. The input limits based on laws and standards are checks for plausibility, not a compliance review.
A qualified engineer should review any design or investment decision taken from these results. You are responsible for the inputs you enter and for how you use and share the results and reports.
To the extent the law allows, the licensors accept no liability for any loss or damage arising from its use or from reliance on its results.

End-user licence agreement

1. Who this licence is between. This End-User Licence Agreement (the Licence) is between you and SMAC Technologies Pty Ltd and Goldmarktech Co., Ltd. (together, the Licensors). It covers SMAC Energy Modeller, its AEM05 engine, its process models, drawings and documentation (the Software). By ticking the box and opening the Software you accept the Licence; if you use the Software for an organisation, you accept it for that organisation and confirm you may do so.

2. What you may do. The Licensors grant you a non-exclusive, non-transferable, revocable licence to use the Software to study and compare HVAC options for buildings, for yourself or for your clients, and to keep, print and share the reports, workbooks and project files it produces, with their notices left in place.

3. What you may not do. You may not copy, modify, translate, decompile, disassemble or reverse engineer the Software, except where the law allows it despite this Licence; remove or obscure its copyright, trademark or licence notices; sell, rent, lend, sublicense or host it for others; use it to build a competing product; or present its results as a certified design, a compliance calculation or a guarantee of performance.

4. Who owns it. The Software, its methods and its content belong to the Licensors or the parties who licensed them. SMAC, the Shaw Method of Air Conditioning, SMAC-100 and Contrologic are methods and names of SMAC Technologies Pty Ltd, and SMAC and the SMAC logo are its trademarks. The Goldmarktech name and logo belong to Goldmarktech Co., Ltd. This Licence grants no rights other than those it states.

5. Your projects and data. Projects you save are kept on the server of this service, under your account. You and the service’s administrators can open them; other members cannot. You can also export any project as a file. You are responsible for the project data you enter and share, and for having the right to use it.

6. Your account. An account is for one named person. Keep your password to yourself and tell the administrators if you think someone else has used it. The administrators approve accounts and may suspend or close an account that breaks this Licence or is no longer used.

7. Personal data. To run your account, Goldmarktech Co., Ltd. keeps your name, email address, company, position and telephone number, when you accepted these terms, signed in and saved projects, and the internet addresses your sign-ins came from. They are used to check and approve your account, to keep it secure and to contact you about it; only the service’s administrators see them, and they are not sold or shared for marketing. They are kept while your account is open and for up to 12 months after it is closed. Under the Personal Data Protection Act B.E. 2562 (2019) you may ask to see, correct, export or delete them, or withdraw your consent, by writing to info@goldmarktech.com.

8. Data and works of others. The Software uses data, standards, published research, fonts and code libraries that belong to others, each under its owner’s terms. They are listed under Credits. Their owners do not endorse the Software or its results.

9. No warranty. The Software is provided as is and as available. Its results are estimates. The Licensors give no warranty that it is free of errors, fit for a particular purpose or that its results will match the performance of a real building, to the extent the law allows.

10. Limits of liability. To the extent the law allows, the Licensors are not liable for any indirect, incidental or consequential loss, or for loss of profit, revenue, savings, data or goodwill, arising from the use of the Software or reliance on its results; and their total liability under this Licence is limited to the amount you paid for it, if any. Nothing in this Licence limits liability that cannot be limited by law.

11. Ending the licence. The Licence ends automatically if you break it. The Licensors may update the Software and this Licence; a new version asks for your acceptance again. When the Licence ends you must stop using the Software.

12. Law. This Licence is governed by the laws of Thailand, and the courts of Bangkok have jurisdiction over any dispute about it.
